We have been focussed on family trust deeds for a few years now. In the lead up to another EOFY, what should we be looking for and at?
 
This session will take you through the important clauses in family trust deeds, especially the clauses we see causing problems for advisers and trustees. These include:

• interpreting beneficiary structures
• income clauses
• essential trustee powers
• variation clauses and the effectiveness of variations.

We all know to ‘read the deed, read the deed, read the deed’. But what are we actually looking for?

This session will help you understand the clauses to look for in a good SMSF trust deed, especially the clauses we see causing problems for advisers and trustees. These include:

• where to look for flexibility
• what is required for effective death benefit planning
• the pension provisions that are required
• the powers of attorney and the dangerous provisions in some trust deeds.
